ART FOR CHARITY – PRIVACY POLICY

The Art for Charity website available at www.artforcharityuk.com  (the “Site”) is operated by The Fine Art Company London Ltd (referred to in this privacy policy as “we”, “us” and “our”). We are committed to protecting and respecting your privacy and this privacy policy contains important information about how we use any personal information that obtain about you and also about how the Site uses cookies. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.
For the purpose of the Data Protection Act 1998 (the “Act”), the data controller in respect of personal data submitted or collected via the Site is The Fine Art Company London Limited of 4, Greendale Road, Nuneaton CV11 6RN.

1. Information we may collect from you and how we use it
1.1 We may collect and process the following data about you and your visits to and use of the Site:
(a) If you submit an order to purchase any Artwork from the Site, we will collect and process the information that you include in your order. The information will include your name, address, email address and other contact details, your payment information, delivery details and information about which charity you wish to receive your Donation (as described in our Purchase Terms and Conditions). We will use this information to process your order, take payment and deliver the Artworks you have purchased to you.
(b) We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns, and does not identify any individual. This information will be collected using cookies (see below) and we use this information to understand how the Site is used to help us improve the Site.
(c) If you contact us for any reason, we may keep a record of that correspondence.
(d) We may also ask you to complete surveys that we use for research purposes. These surveys may be undertaken on an anonymous, but in any case you do not have to respond to them.
(e) If you consent for us to do so, we may collect your contact details to enable us to send you updates about the charities you have supported, newsletters and other marketing information about us or the artists whose work we think you may like.
1.2 Payments for Artworks will be handled by our third party payment processors, Paypal, and so you will be required to submit your payment information to them to complete a purchase of Artwork via the Site. We will not collect or store any credit card information as this is dealt with by Paypal. Please refer to Paypal’s privacy policy for more information about how Paypal handle data submitted to them.

2. Cookies
2.1 As noted above, the Site uses cookies to collect certain aggregated information about the way in which the Site is used. A cookie is a small file of letters and numbers that we put on your computer which enables us to see how you access and use the Site during your visit and helps us to provide you with a good experience when you browse our Site and also allows us to improve our Site. The cookies we use to do this are known as “analytical” cookies and more information about the particular cookies we use can be found at [ http://www.google.com/analytics/  ]. This cookie does not collect any information that would enable us to identify you.
2.2 We also use a cookie to remember what Artworks you have placed in your shopping basket before you complete your order. This cookies is essential to the operation of the shopping basket and without it you would not be able to purchase any Artworks.
2.3 By using this Site you consent to our use of the cookies described above.

3. Disclosure of your information
3.1 We may disclose your personal information to third parties as follows:
(a) If you have given us your consent to do so, we may disclose your name and contact details to the charities that you have chosen to support when purchasing any Artwork from the Site so that they can contact you with newsletters and other communications.
(b) We will disclose your payment information to our third party payment processor who will process your payment for the purchase of any Artwork on our behalf.
(c) In the event that we sell any business or assets, we may disclose your information to the prospective seller or buyer of such business or assets so as to enable them to continue such business.
(d) We may disclose your information to any person that owns the intellectual property rights in any Artwork you have purchased where we have reason to believe that such disclosure is necessary in connection with the enforcement of such person’s rights.
3.2 We may engage third party data processors to undertake processing of personal data on our behalf.
3.3 We may disclose your personal information if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce our legal rights or to protect the rights, property, or safety of The Fine Art Company London Ltd, our suppliers, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.
3.4 We may disclose your personal information to any member of our group from time to time, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

4. Storage of your personal data
4.1 We will retain any personal data that we collect about you for as long as is necessary to complete the purpose for which it was collected. We may retain it thereafter for as long as the Act or any other applicable law permits or requires us to do so.
